Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the RhythmBattle mobile application ("App") or accessing the RhythmBattle website at rhythmbattle.xyz ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Site.

These Terms constitute a legally binding agreement between you and No Filter Software ("we," "us," or "our"), the developer and operator of RhythmBattle. By using the App or Site — including in Guest Mode without creating an account — you confirm that you are at least 13 years of age and have the legal capacity to enter into this agreement. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

RhythmBattle is a dance-scoring mobile application that uses your device's built-in motion sensors — including the accelerometer and gyroscope — to track and score your dancing in real time. The App measures rhythm, intensity, and flow as you move with your phone, and posts your scores to global leaderboards so you can compete with other dancers worldwide.

Core features of the Service include:

• Real-time dance scoring using your device's motion sensors during active dance sessions.
• Global leaderboards that rank players by score across various tracks and categories.
• User accounts with score history, personal stats, and profile information.
• Guest Mode, which allows access to core dance features without creating an account. Guest scores are not saved to a permanent profile or submitted to leaderboards.
• In-app music, including built-in genre playlists and exclusive Shift+Ctrl AI music tracks, streamed during dance sessions.

The App is currently available on iOS via TestFlight and the Apple App Store. We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice.

3. Device Damage Disclaimer

No Filter Software is not responsible for any damage to, loss of, or destruction of your mobile device or any other property that occurs while using the App. This includes, without limitation:

• Cracked screens, broken components, or physical damage resulting from dropping your device during a dance session.
• Damage caused by your device striking furniture, walls, floors, other people, or any other surface or object.
• Loss of your device due to it being flung, thrown, or dropped beyond recovery.
• Water or liquid damage if your device contacts beverages or surfaces while dancing.
• Damage to accessories, cases, or peripheral equipment attached to or used alongside your device.
• Damage to any other property, objects, or surfaces caused by your device during use.

You use the App with your mobile device at your own risk. We strongly recommend using a secure grip or wrist strap when dancing with your phone, and ensuring you have adequate space around you before beginning a session. No Filter Software will not replace, repair, or compensate you for any device or property damaged in connection with your use of the App, regardless of the circumstances.

4. Personal Injury Disclaimer

No Filter Software is not responsible for any personal injury, bodily harm, illness, or death that occurs while using the App or engaging in any physical activity in connection with the App. This includes, without limitation:

• Sprains, strains, fractures, or other musculoskeletal injuries sustained while dancing.
• Falls, trips, or collisions with furniture, walls, other people, or other objects in your environment.
• Injuries resulting from dancing in an area with insufficient space or unsuitable flooring.
• Cardiovascular events, dizziness, or other health incidents arising from physical exertion.
• Injuries caused by being struck by your own device or by another person's device during use.
• Aggravation of any pre-existing physical condition or injury.

Before using RhythmBattle, you should ensure that you are in adequate physical condition to engage in the activity and that your environment is safe, clear of hazards, and has sufficient open space for movement. If you have any medical condition, physical limitation, or concern about your ability to engage in physical activity, consult a qualified healthcare professional before using the App.

You assume full and sole responsibility for any injury or harm that occurs while using the App. No Filter Software makes no representations about the safety of any physical activity undertaken in connection with the App.

5. User Accounts and Guest Mode

Creating an Account. You may create a registered account using an email address and password. You agree to provide accurate, current, and complete information at registration, and to keep that information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you become aware of any unauthorized use of your account, notify us immediately at support@rhythmbattle.xyz.

Account Responsibility. You are solely responsible for all activity that occurs under your account, whether or not authorized by you. We are not liable for any loss or damage arising from unauthorized access to your account that results from your failure to keep your credentials secure.

One Account Per Person. You may not create more than one account for the purpose of gaining an unfair competitive advantage on the leaderboards, circumventing a suspension or ban, or otherwise manipulating the Service.

Guest Mode. The App offers a Guest Mode that allows you to use the core dance-scoring features without creating an account. In Guest Mode, your scores and session data are not saved to a persistent profile and are not submitted to global leaderboards. All provisions of these Terms apply equally to Guest Mode users.

Account Termination. We reserve the right to suspend or terminate any account at our sole discretion, including for violation of these Terms, suspected cheating or score manipulation, or conduct that is harmful to other users or the integrity of the Service. You may delete your account at any time by contacting us at support@rhythmbattle.xyz.

6. User Conduct

You agree to use the App and Site only for lawful purposes and in a manner consistent with these Terms. You agree that you will not:

• Attempt to manipulate, falsify, or artificially inflate your scores or leaderboard rankings through any means, including using third-party tools, modified versions of the App, emulators, or any other method that does not reflect genuine physical activity.
• Use the App in a way that interferes with or disrupts the integrity or performance of the Service or its servers.
• Attempt to gain unauthorized access to any portion of the App, Site, or our systems or infrastructure.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Use any automated script, bot, or tool to interact with the App or Site.
• Create a false identity or impersonate another person in connection with your use of the Service.
• Use the Service for any commercial purpose without our express prior written consent.
• Violate any applicable local, state, national, or international law or regulation in connection with your use of the Service.

We reserve the right to investigate suspected violations of these conduct standards and to take appropriate action, including removing scores, suspending or terminating accounts, and, where appropriate, reporting conduct to law enforcement authorities.

7. Intellectual Property

All content, features, and functionality of the App and Site — including but not limited to the software, code, design, graphics, logos, scoring algorithms, music tracks, text, and all other materials — are owned by No Filter Software or its licensors and are protected by applicable intellectual property laws.

These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial entertainment purposes in accordance with these Terms. This license does not include any right to:

• Copy, reproduce, distribute, or publicly display any content from the App or Site.
• Modify, create derivative works from, or exploit any part of the App or Site.
• Use any of our trademarks, logos, or brand elements without our prior written consent.
• Sub-license, sell, resell, transfer, or otherwise commercially exploit the App or any content.

The RhythmBattle name, logo, and associated branding are trademarks of No Filter Software. All rights not expressly granted in these Terms are reserved.

The Shift+Ctrl AI music tracks available within the App are licensed for in-app use only. You may not record, reproduce, distribute, or use those tracks outside of the App without separate written authorization.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NO FILTER SOFTWARE AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP OR SITE. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR:

• Loss of data, scores, or leaderboard standing.
• Personal injury or bodily harm sustained while using the App.
• Damage to or loss of your mobile device or other property.
• Service interruptions, errors, or bugs.
• Any other matter relating to the Service, however arising and under any theory of liability.

IN NO EVENT SHALL NO FILTER SOFTWARE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO NO FILTER SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law. The limitations in this section apply regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise, and even if No Filter Software has been advised of the possibility of such damages.

9. Disclaimer of Warranties

THE APP AND SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NO FILTER SOFTWARE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranty that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• Any warranty regarding the accuracy, completeness, or reliability of scores, leaderboard data, or any other information provided through the App.
• Any warranty that the App will function correctly on any particular device, operating system version, or hardware configuration.

We do not warrant that defects in the App will be corrected, or that the App or the servers that make it available are free of viruses or other harmful components. You assume all risk associated with using the App, including all risks associated with physical activity.

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the foregoing exclusions apply to the extent permitted by applicable law.

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the effective date shown at the top of this page. For material changes, we will make reasonable efforts to provide notice — for example, by displaying a notice within the App or on the Site.

Your continued use of the App or Site after updated Terms are posted constitutes your acceptance of those updated Terms. If you do not agree to any updated Terms, you must stop using the App and Site. We encourage you to review these Terms periodically.

11. Governing Law

These Terms and any dispute arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located within the State of California, and you consent to the personal jurisdiction of those courts. Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent or stop any breach or threatened breach of these Terms.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
